CONDITIONS

These Terms and Conditions (‘Terms’) govern your access to and use of Aether’s confidential demonstration videos (the ‘Demos’). By requesting and accessing the Demos, you agree to be bound by these Terms.

Please read these Terms carefully before proceeding. If you do not agree with any part of these Terms, you must not request or access the Demos.

Provider: In The Aether Ltd, a company registered in England and Wales (Company Number 16555471), with registered office at 86-90 Paul Street, 3rd Floor, London, EC2A 4NE (‘Aether’, ‘we’, ‘us’, ‘our’).


1. ACCESS AND USE

1.1 Access Credentials: Upon approval of your Demo access request, you will receive password-protected credentials to view the Demos. These credentials are provided on a shared basis and may be used by multiple approved users.

1.2 Credential Validity: Access credentials remain valid until Aether changes or revokes them. We reserve the right to modify or revoke access at any time without prior notice.

1.3 Intended Use: The Demos are intended for business and professional evaluation purposes only. You must be 18 years of age or older to request access.

1.4 Pre-Release Status: The Demos showcase pre-release features and concepts. Content shown may not reflect the final product at launch and is subject to change without notice. Aether makes no warranties regarding the accuracy, completeness, or fitness for any particular purpose of the Demos.


2.  CONFIDENTIALITY OBLIGATIONS

2.1 Confidential Information: All content within the Demos, including but not limited to: video recordings, user interface designs, AI coaching methodologies, problem-solving frameworks, platform architecture, feature demonstrations, Sarah Chen scenarios, zone structures (Sparks, Sessions, Solutions, Sanctuary), and any associated documentation, constitutes confidential and proprietary information of Aether (‘Confidential Information’).

2.2 Non-Disclosure: You agree to maintain the strict confidentiality of all Confidential Information and not to disclose, share, publish, or communicate any Confidential Information to any third party without Aether's prior written consent.

2.3 Prohibited Actions: You agree NOT to:

a)    Create screenshots, screen recordings, photographs, or any other reproductions of the Demos in any format;

b)    Share your access credentials with any third party;

c)    Provide detailed descriptions, summaries, or explanations of the Demos, platform features, methodologies, or technical architecture to any third party;

d)    Reverse engineer, decompile, disassemble, or attempt to derive the source code, underlying ideas, algorithms, or AI coaching prompts from the Demos;

e)    Use any Confidential Information to develop, enhance, or contribute to any competing product, service, or business;

f)     Discuss your experience with the Demos publicly (including on social media platforms such as LinkedIn, blogs, podcasts, conferences, or in professional forums) without prior written approval from an Aether Director (Claire Bowers or Sharon Zimmerli)

2.4 Permitted Sharing: You may refer interested parties to Aether’s official website to request their own Demo access.


3. INTELLECTUAL PROPERTY

3.1 Ownership: All intellectual property rights in and to the Demos, including but not limited to copyrights, trademarks, trade secrets, patents, and know-how, are and shall remain the exclusive property of Aether. These Terms do not grant you any ownership rights or licences beyond the limited right to view the Demos for evaluation purposes.

3.2 Feedback Ownership: Any feedback, suggestions, comments, ideas, or other contributions you provide to Aether (including responses to the Demo feedback questionnaire) shall become the sole and exclusive property of Aether. You hereby assign all rights, title, and interest in such feedback to Aether, and Aether may use such feedback for any purpose without compensation or attribution to you.


4. THIRD-PARTY REFERRALS

4.1 Referral Email Service: If you provide contact details for a decision-maker at your organisation through the Demo feedback questionnaire (Question 4), you instruct and authorise Aether to send a single introductory email on your behalf to that individual. The exact text of this email is set out below in Section 4.2.

4.2 Standard Referral Email: By agreeing to these Terms, you acknowledge and consent that Aether will send the following email (with appropriate personalisation based on the information you provide):

         Subject Line: [Colleague’s First Name] suggested you see Aether's demo

Email Body:

Dear [Decision-Maker Name],

A colleague at [Organisation Name] recently experienced Aether’s future of work demonstration videos and thought you should see them.

The problem we’re solving: Most organisations lose millions annually because brilliant ideas stay trapped in people’s heads, never captured, never heard, never acted upon. The best problem-solvers in your business often aren't the ones in the boardroom.

What Aether does: We've built an AI-powered platform that captures fleeting insights, guides cross-functional teams through structured problem-solving, and transforms promising ideas into leadership-ready business cases.

4.3  Your Warranties: By providing a third party's contact details, you warrant that:
a)     You have authority within your organisation to facilitate business introductions of this nature; OR
b)     You have informed the referred individual that you are providing their details to Aether for this specific purpose.

4.4 Single Communication: Aether will send only the email specified in Section 4.2. The referred individual will not be added to any marketing lists or contacted further unless they independently engage, request Demo access or join Aether's waitlist.

4.5 Data Processing: Personal data of referred individuals (name, title, email address, organisation name) will be processed solely for the purpose of sending this introductory email. This data will be retained for 30 days after sending the referral email and then deleted, unless the individual has independently engaged with Aether. Processing is conducted under your instruction as data controller for this specific communication.

4.6 Your Indemnity: You agree to indemnify and hold Aether harmless from any complaints, claims, or regulatory action arising from your provision of third-party contact details or the sending of the referral email on your behalf.


5. DATA PROTECTION AND ANALYTICS

5.1 Data Collection and Processing: Your personal information (name, email address, company name, role, and questionnaire responses) is collected and processed via Squarespace, our website hosting platform. We use this information to:

  • Manage Demo access requests and send credentials

  • Collect feedback through the Demo questionnaire

  • Contact referred decision-makers (where you’ve provided their details)

  • Send product launch updates and communications if you choose to join our product waitlist (optional)

If you join our product waitlist, you consent to receive notifications about Aether's launch dates, new features, pricing information, and early access opportunities. You may unsubscribe from waitlist communications at any time via the unsubscribe link in emails or by contacting info@intheaether.io. Waitlist data will be retained until product launch, unsubscribe, or 24 months, whichever comes first.

5.2 Analytics: We collect basic usage analytics including page views, time spent on pages, and general viewing behaviour through Squarespace's analytics tools. This data is used to improve the Demo experience and inform product development.

5.3 Your Rights: You have rights regarding your personal data under UK data protection law. For full details on how we collect, use, and protect your information, please see our Privacy Policy.


6. BREACH AND REMEDIES

6.1 Breach Consequences: Any breach of these Terms, particularly the confidentiality obligations in Section 2, will be considered a material breach. Upon becoming aware of any breach, Aether may immediately terminate your access to the Demos and pursue all available legal remedies.

6.2 Legal Action: Aether reserves the right to seek injunctive relief, damages, and any other remedies available at law or in equity for any breach of these Terms. You acknowledge that monetary damages may not adequately compensate Aether for breach of confidentiality obligations and that Aether shall be entitled to seek equitable relief, including injunction and specific performance.

6.3 Costs Recovery: In the event of breach, you may be liable for Aether's reasonable legal costs and expenses incurred in enforcing these Terms.
