These Terms and Conditions ('Terms') govern your access to and use of Aether's confidential demonstration videos (the 'Demos') and Aether Glimpse, a free proof-of-concept AI coaching tool ('Aether Glimpse'). By requesting and accessing the Demos or Aether Glimpse, you agree to be bound by these Terms.

Please read these Terms carefully before proceeding. If you do not agree with any part of these Terms, you must not request or access the Demos or Aether Glimpse.

1. ACCESS AND USE

1.1 Access credentials: Upon approval of your access request, you will receive password-protected credentials to view the Demos and access Aether Glimpse. These credentials are provided on a shared basis and may be used by multiple approved users.

1.2 Credential validity: Access credentials remain valid until Aether changes or revokes them. We reserve the right to modify or revoke access at any time without prior notice. 

1.3 Intended use: The Demos are intended for business and professional evaluation purposes only. You must be 18 years of age or older to request access.

1.4 Pre-release status: The Demos and Aether Glimpse showcase pre-release features and concepts. Content shown may not reflect the final product at launch and is subject to change without notice. Aether makes no warranties regarding the accuracy, completeness, or fitness for any particular purpose of the Demos and Aether Glimpse.

1.5 Aether Glimpse – Nature of service: Aether Glimpse is a free, proof-of-concept AI coaching tool provided for the purpose of learning and development. It aims to provide a 1-to-1 problem-solving coaching experience. Aether Glimpse is provided at no charge and Aether reserves the right to modify, suspend, or revoke access to Aether Glimpse at any time, without prior notice and without liability.

1.6 Aether Glimpse – Pre-release status: Aether Glimpse is an early-stage proof of concept and does not represent the final product. It is offered on an experimental basis. Aether makes no warranties regarding its accuracy, availability, completeness, or fitness for any particular purpose.

2. CONFIDENTIALITY OBLIGATIONS

2.1 Confidential information: All content within Aether Glimpse and the Demos, including but not limited to: video recordings, user interface designs, AI coaching methodologies, coaching interactions, problem-solving frameworks, platform architecture, feature demonstrations, Sarah Chen scenarios, zone structures (Sparks, Sessions, Solutions, Sanctuary), and any associated documentation, constitutes confidential and proprietary information of Aether ('Confidential Information').

2.2 Non-disclosure: You agree to maintain the strict confidentiality of all Confidential Information and not to disclose, share, publish, or communicate any Confidential Information to any third party without Aether's prior written consent.

2.3 Prohibited actions: You agree NOT to: 

a)    Create screenshots, screen recordings, photographs, or any other reproductions of the Demos or Aether Glimpse in any format;

b)    Share your access credentials with any third party;

c)    Provide detailed descriptions, summaries, or explanations of the Demos, platform features, methodologies, or technical architecture to any third party;

d)    Reverse engineer, decompile, disassemble, or attempt to derive the source code, underlying ideas, algorithms, or AI coaching prompts from the Demos or Aether Glimpse;

e)    Use any Confidential Information to develop, enhance, or contribute to any competing product, service, or business;

f)     Discuss your experience with the Demos or Aether Glimpse publicly (including on social media platforms such as LinkedIn, blogs, podcasts, conferences, or in professional forums) without prior written approval from an Aether Director (Claire Bowers or Sharon Zimmerli)

2.4 Permitted sharing: You may refer interested parties to Aether’s official website to request their own Demo or Aether Glimpse access. 

3. INTELLECTUAL PROPERTY

3.1 Ownership: All intellectual property rights in and to the Demos and Aether Glimpse, including but not limited to copyrights, trademarks, trade secrets, patents, and know-how, are and shall remain the exclusive property of Aether. These Terms do not grant you any ownership rights or licences beyond the limited right to view the Demos for evaluation purposes or experience Aether Glimpse as part of a Beta testing experience trial.

3.2 Feedback ownership: Any feedback, suggestions, comments, ideas, or other contributions you provide to Aether (including responses to the Demo or Aether Glimpse feedback questionnaire) shall become the sole and exclusive property of Aether. You hereby assign all rights, title, and interest in such feedback to Aether, and Aether may use such feedback for any purpose without compensation or attribution to you.

4. DATA PROTECTION AND ANALYTICS

4.1 Data collection and processing: Your personal information (name, email address, company name, role, and questionnaire responses) is collected and processed via Squarespace, our website hosting platform. We use this information to:

• Manage Demo or Aether Glimpse access requests and send credentials

• Collect feedback through the Demo or Aether Glimpse questionnaire

• Send product launch updates and communications if you choose to join our product waitlist (optional)

If you join our product waitlist, you consent to receive notifications about Aether's launch dates, new features, pricing information, and early access opportunities. You may unsubscribe from waitlist communications at any time via the unsubscribe link in emails or by contacting info@intheaether.io. Waitlist data will be retained until product launch, unsubscribe, or 24 months, whichever comes first.

4.2 Analytics: We may collect basic usage analytics including page views, time spent on pages, and general viewing behaviour through Squarespace's analytics tools. This data is used to improve the Demo experience and inform product development.

4.3 Your rights: You have rights regarding your personal data under UK data protection law. For full details on how we collect, use, and protect your information, please see our Privacy Policy.

4.4 Aether Glimpse AI processing: Aether Glimpse is powered by OpenAI's API. In order to function, Aether Glimpse transmits data to OpenAI, which is based in the United States. Your sign-in information, such as your name and email address, is held by Squarespace and is not shared with OpenAI. This international transfer is made on the basis of appropriate safeguards maintained by OpenAI; for further details, please see OpenAI's privacy policy and terms of service at openai.com. We process this data on the basis of your consent. By using Aether Glimpse, you acknowledge and consent to this transfer.

4.5 Aether Glimpse, usage analytics and session feedback: We process the following data on the basis of your consent. We collect basic usage analytics for Aether Glimpse, including session open rates and session completion rates (defined as sessions in which a user reaches the resolution pathway stage), via usage telemetry hosted on Render.com. This data is collected in aggregate and is not attributed to individual users. At the conclusion of an Aether Glimpse session, you may be invited to respond to a short feedback questionnaire. Your responses are recorded via Squarespace, and retained for the duration of Aether's product development phase or 24 months from collection, whichever comes first. This data is used solely to inform Aether's research and product development.

5. BREACH AND REMEDIES

5.1 Breach consequences: Any breach of these Terms, particularly the confidentiality obligations in Section 2, will be considered a material breach. Upon becoming aware of any breach, Aether may immediately terminate your access to the Demos and pursue all available legal remedies.

5.2 Legal action: Aether reserves the right to seek injunctive relief, damages, and any other remedies available at law or in equity for any breach of these Terms. You acknowledge that monetary damages may not adequately compensate Aether for breach of confidentiality obligations and that Aether shall be entitled to seek equitable relief, including injunction and specific performance.

5.3 Costs recovery: In the event of breach, you may be liable for Aether's reasonable legal costs and expenses incurred in enforcing these Terms.

6. DISCLAIMERS AND LIMITATION OF LIABILITY

6.1 As-Is provision: The Demos and Aether Glimpse are provided 'as is' and 'as available' without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

6.2 No guarantees: Aether makes no representations or warranties regarding the accuracy, reliability, completeness, or timeliness of the Demos and Aether Glimpse. Features shown in the Demos and Aether Glimpse may be modified, delayed, or not included in the final product.

6.3 Limitation of liability: The Demos and Aether Glimpse are provided 'as is' for evaluation and experience purposes only. Aether Platform-widemakes no guarantees that features shown will be included in the final product.

7. TERM AND TERMINATION

7.1 Duration: These Terms remain in effect indefinitely from the date you first access the Demos and Aether Glimpse, unless terminated earlier in accordance with this Section 8.

7.2 Termination by Aether: Aether may terminate your access at any time by changing the access credentials. Such termination does not relieve you of your continuing obligations under these Terms, particularly the confidentiality obligations in Section 2.

7.3 Survival: Sections 2 (Confidentiality), 3 (Intellectual Property), 4 (Third-Party Referrals), 5.4 and 5.5 (Aether Glimpse Data Processing), 6 (Breach and Remedies), 7 (Disclaimers), and 9 (General Terms) shall survive any termination of these Terms.

8. GENERAL TERMS

8.1 Modifications: Aether reserves the right to modify these Terms at any time. Modified Terms will apply to users who request Demo and Aether Glimpse access after the modifications are published. Continued access to the Demos access following publication of modified Terms constitutes acceptance of the modified Terms.

8.2 Governing law: These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

8.3 Jurisdiction: The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation.

8.4 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

8.5 Entire agreement: These Terms constitute the entire agreement between you and Aether regarding your access to and use of the Demos and Aether Glimpse & supersede all prior agreements and understandings, whether written or oral.

8.6 Waiver: No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.

8.7 Assignment: You may not assign or transfer these Terms or any rights granted hereunder without Aether's prior written consent. Aether may freely assign these Terms.
